About these terms

These terms apply when you browse Kelmere Living or place an order with us. Please read them together with our Shipping, Refund and Privacy policies.

Eligibility and account information

You must provide accurate information when ordering and be legally capable of entering into a contract. You are responsible for keeping any account or checkout details secure.

Products

We describe products with reasonable care. Images are illustrative; colours, texture and scale may appear slightly different because of lighting, photography or display settings. Measurements are approximate unless expressly stated otherwise.

Prices and payment

Prices are shown in GBP. Applicable taxes are included where stated at checkout. Payment is collected using the methods offered at checkout. An order is not accepted if payment is not authorised.

Ordering and contract formation

Submitting an order is an offer to buy. An automated acknowledgement confirms receipt, not acceptance. A contract is formed when we accept the order and confirm dispatch.

Availability and order cancellation

Products remain subject to availability. We may decline or cancel an order where an item is unavailable, information or pricing is materially incorrect, payment is not authorised or fraud is reasonably suspected. Any payment taken for a cancelled order will be refunded.

Delivery

Delivery destinations, charges and estimates are described in our Shipping Policy. Risk in the goods passes to you when they are delivered to you or a person you identify to receive them. Ownership passes when full payment has been received.

Cancellations and returns

Your cancellation and return options are described in our Refund Policy. Nothing in these terms limits statutory rights relating to goods that are faulty, not as described or not fit for purpose.

Acceptable website use

Do not misuse the website, attempt unauthorised access, introduce malicious code, interfere with normal operation or use the website for unlawful activity.

Third-party services and links

Checkout, payment and other functions may be provided by Shopify or other service providers. External links are provided for convenience; we are not responsible for third-party content or services outside our control.

Liability

Nothing excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Subject to that, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a consumer purchase.

Events outside reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control, but this does not remove rights that the law gives you.

Changes, severability and waiver

We may update these terms for legal, regulatory or operational reasons. If part of these terms is unenforceable, the remaining terms continue to apply. A delay in enforcing a right does not waive it.

Governing law and complaints

These terms are governed by the laws applicable in the United Kingdom. You retain mandatory consumer protections that apply to you. Contact us first if you have a complaint so we can try to resolve it.
